These Terms and Conditions (“the Terms and Conditions”) govern your (“the User”) use of the Pro Tackle Store (Pty) Ltd website located at the domain name www.protacklestore.co.za (“the Website”). By accessing and using the Website, the User agrees to be bound by the Terms and Conditions set out in this legal notice.

This site may be used to browse the content and to make a purchase. The User may not access, display, use, download, and/or otherwise copy or distribute content obtained on the website for marketing and other purposes without the consent of Pro Tackle Store.
Updating of Terms and Conditions
Pro Tackle Store reserves the right to change, modify, add to or remove from portions or the whole of these Terms and Conditions from time to time. Changes to these Terms and Conditions will become effective upon such changes being posted to this website. It is the customer’s obligation to periodically check these Terms and Conditions at the website for changes or updates. The customer’s continued use of this website following the posting of changes or updates will be considered notice of the customer’s acceptance to abide by and be bound by these Terms and Conditions, including such changes or updates.
Electronic Communications
By using the Pro Tackle Store website or communicating with us by electronic means, the user consents and acknowledges that any and all agreements, notices, disclosures, and/or any other communication satisfies any legal requirement, including but not limited to the requirement that such communications should be in writing.
E-Commerce & Privacy
The use of any product bought from this website is at the purchaser’s risk. The purchaser/user indemnifies and holds the provider harmless against any loss, injury or damages which may be sustained as a result of using the products sold on the website.
The private information required for executing the orders placed through the e-commerce facility, namely the user’s personal information and credit card details, delivery address and telephone numbers will be kept in the strictest confidence by the provider and not sold or made known to third parties. Only the necessary information, that is the delivery address and contact phone number will be made known to third parties delivering the product.
The provider undertakes that it has taken all reasonable precautions to secure the credit card processing that is carried out to receive payment for goods sold. The provider cannot be held responsible for security breaches occurring on the user’s electronic device (personal computer or other electronic device used to browse the website), which may result due to the lack of adequate virus protection software or spyware that the user may inadvertently have installed on his/her device.
Purchasing/Cancellation Policy
When you place an order on our website we shall email you an acknowledgement. Once you have checked out and your order has been confirmed you will not be able to make any changes to your order so please make sure that everything is correct before submitting your order.
Cancelled orders on this website will be refunded after the deduction of a 15% charge for administration costs. Pro Tackle Store reserves the right to cancel an order for which payment has already been received. This may occur if stock is insufficient, irrespective of the stock count online, or if the quality of the products ordered does not meet our standards. Should Pro Tackle Store exercise this right, the customer will receive a full refund with no deductions.
Returns & Refunds Policy
An order can be cancelled if payment has not yet been made by the costumer. If you notice that you have received an incorrect product, or you have a damaged or faulty item, let our customer service team know within two business days, by emailing us on returns@protacklestore.co.za. One of our team members will get back to you during office hours, and we will gladly collect it at either Pro Tackle Store’s or the customer’s expense, depending on circumstances. Pro Tackle Store reserves the right to either provide you with a refund, swop or replace the item within 14 days, provided the item is in its original condition (hasn’t been used) and original packaging. This decision will be made at Pro Tackle Store’s discretion.
In accordance with the Consumer Protection Act, you are entitled to cancel your order within 7 days after receipt thereof. Therefore, if you have used a product and found it to be damaged or faulty, the following steps need to be en:
- Email us on returns@protacklestore.co.za, explaining the reason for return.
- We will advise you if we approve return of the product whereupon you may courier or post the item back to us
- All items that are returned must be sent to us using a trackable and insured delivery method.
- Items need to be returned within 14 days after they have been approved for return
- Items need to be received in original condition and original packaging. Refunds will only be considered where the items are in their unused original sealed packaging.
- Items that are returned need to be properly packaged to ensure there is no damage during the return process.
- Items which received damaged due to insufficient packaging and handling will be subject to partial or no refund.
- Shipping/courier costs are non-refundable and will be for the customer’s account.
- Sales items cannot be returned and all sales are final.
- Pro Tackle Store reserves the right to charge a 25% administration fee for returned orders should the returns process incur significant administration expenses.
- Once received, you will be refunded the purchase price of the items within 30 days less any delivery/courier fee.
Availability of Stock
Sometimes it does happen that between the time when the order is placed and payment is received, an item goes out of stock. In this case Pro Tackle Store will inform you as soon as possible of the shortage and will place the item on back-order or refund the client in full within 30 days. We cannot be liable for items which are out of stock from the supplier.
Delivery Policy
Subject to availability and receipt of payment, orders will be processed within two business days and handed over to a courier company for delivery. For all main regional areas, delivery is estimated to take 3 to 5 business days from the day of dispatch. For outlying areas, please allow an additional 2 days for delivery. In very remote areas that are not serviced by standard couriers, the provider reserves the right to deliver via Post Office or to the nearest town to the user that is accessible by our couriers within their normal routes. In these circumstances, Pro Tackle Store will be in contact with the user to advise and arrange particulars.
We will supply all products to the delivery company in good order and will ensure that products arrive at the purchaser’s chosen delivery address in the same good order.

Payment Options
Payment can be made via EFT, Visa or MasterCard into the Pro Tackle Store bank account, the details of which will be provided after checkout. Diners or American Express credit cards are not accepted.
Please note, when selecting to pay by EFT, you have 48 hours after placing your order and receiving your Tax Invoice to make the payment.
When making your payment, please be sure to use your order number as reference.

The delivery lead time as specified on the website only starts once Pro Tackle Store has received the payment from your bank.
Payment Safety & Security
CREDIT CARD SECURITY
Credit card transactions will be acquired for PayFast (Pty) Ltd who are an approved payment gateway in South Africa. PayFast uses the highest level of encryption currently available (Extended Validation SSL with 256-bit encryption – only two of the four major South African banks use this). The company registration documents and the site’s registered domain name are checked and verified by Thawte. 3D Secure is in place for all credit card transactions. All sensitive information is encrypted within their own database. Users may go to https://www.payfast.co.za/s/std/security to view their security certificate and security policy.
Transaction Currency
The transaction currency is South African Rand (ZAR). Prices are subject to change without notice.
Responsibility
Pro Tackle Store takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods. We will take all reasonable efforts to maintain correct prices on the website and Tax Invoices. Should errors occur or items be offered at incorrect prices, we will not be obliged to sell goods at such incorrect prices and shall only be liable to refund.
